closing help!!!!!

My wife and I are closing on a house or supposed to close by Sept 30, thats whats in are contract. The problem is the banks take so long to do paper work, and there is a back up offer for full price. Today we are supposed to sign the papers, but my agent is saying it might nor recort til tue or wed. Are the banks liable if they don't fund by the closing date?
