Closing TimeWhat is the name of your state? Oklahoma Hello. I was wondering how long the seller has to get out of the home once we close. We are in Oklahoma. Also, are they supposed to cash your earnest money check before you close? |

| Most sane individuals would have it written into their contract that possession is at closing. You get into all kinds of messes when one allows otherwise. Let us guess no realtor and no Atty, that is the other thing a sane individual would NOT do. Is this a FSBO by any chance? |

| It IS normally established in the offer, or by addendum before or at closing. Honestly, I see hundreds of closings, and in many cases, the occupancy will be same or next day, but the home is NOT vacant qat closing, because the seller must go close on the house they are buying using the proceeds of the house they are sellling. So they close sale in a.m., and purchase in p.m., while the movers are emptying one house, and going to the next. There is usually a "use and occupancy charge" plus an "escrow to guaranty occupancy" should the party not be out by the required day. Ther earnest money check ABSOLUTELY should be cashed and deposited. Normally the realtor or title company holds it in their account until closing. If there are not funds on deposit, there is no earnest money to hold the buyers- they could simply cancel the check. So the funds should be on deposit when recieved.
