If I advertised I owned a particular house on Ebay and made representation that I did own 100% of the house and stated that I could only transfer quit claim deed. In other words, I thought I owned the house (but unknowingly only owned half of the house because of a problem with the title) and the person who purchased the house found that there was a cloud on the title after the quitclaim transfer, that I in fact only owned half of the house, the person had believed me and gave the money and didn't understand that you need to do a title search. Would I be legally responsible to fix the title problem?

The reason there was a title problem was because the city made a mistake and had the property taxes for lot C and D together to be paid by me. Lot D was never was conveyed. A later title search showed this but I thought both lots were mine because I paid the taxes for the last 15 years. As it turns out the house straddles both lots. How would a Judge rule on this?

Nope. You would be legally responsible for giving him half the 'purchase price', since he only purchased YOUR half (and not the whole you advertised) OR you could remedy the title problem OR you could have a judgment rendered against you AND you could face criminal fraud charges (depending on the full facts).

You better hope it does not turn out to be a criminal judge. You knew all this going in and you committed fraud and you knew the way to possibly get by was to sell to some sucker on ebay!
