north carolina. husband and i have contingency contract on new construct home based on selling our home now. they gave us 30 days to sell our home. agent says that we are subject to any base price increases after 30 days - already in 3 weeks base price has risen $2,500. is this legal?

If that condition is written in the purchase contract it is legal.
