Contract questions - NYC


I am in contract to close on a house.

The house is owned by my grandmother (deceased in 1998). She left no will. My father and uncle are going to inherit the property. I am going to buy the property.

My question is my father owes child support in the amount of $31,000. $10,758 which is owed to Department of Social Service and the other 21,000 is owed to my mother (who is also deceased). The title company is holding me up. They want the judgement of $10,758 paid, which I can pay. The other 21,000 will still not be cleared as my father has to go to court. Will the title company allow me to pay the $10,758 while the other $21,000 is still pending in court?

I have a $10,000 deposit on the property. There is no contingency clause at all (my uncle is a prick). The only thing is the contract says if my uncle cannot convey title to the property than my deposit is refundable. What about my father his name is on the contract, he cannot convey title, isn't he a seller in this?

If I back out of this deal, what fees will I have to pay (lender, attorney, etc.).

Please help.
