Question

Damage Disclosure


I'm in the process of buying a house in North Dakota. The closing is on Jan 31st. the damage disclosure states no damage or repairs to roof. at second check it was filled out on 3/28/01. before we had a MAJOR hail storm. with talking to the realtor yesterday we found out that the roof was damaged (I feel they were trying to keep that from us) and when my realtor asked what they would do about it they stated that they would buy the shingles. My ? is "if the roof was damaged and not fixed and this person got paid by insurance to replace the roof is it legal for him to try not to give me that money?" Also it is looking like his realtor knew about this and did not bring it to our attention is this legal for her to knowingly try to hide information of this sort from my realtor.

Any help would be appreciated

This one is really simple.....

Since you haven't purchased the home, you haven't been damaged. And now, since you know about the damage, you have no claim if you close with full knowledge.

Your issue at this point is, will you accept the house and close as scheduled, or will the seller negotiate a price adjustment to compensate for the estimated cost of any required repairs???

A: Absolutely. You have NO rights to the insurance funds paid to him by HIS insurance company.

A: Same catch-22 as above. You haven't been damaged, so there is no 'foul' here. You can certainly file a complaint with the state real estate licensing 'folks' since it does sound like the agent MIGHT have been deceptive. But you have no direct legal recourse against her.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
