Date of Escrow Closing Has Past and We Want Out

My wife and I are in escrow on a home in CA. The escrow closing date has past due to the fact that the seller is waiting for a July 13th court date to have a conservatorship granted for one of the elder seller's who has alzheimers. We are tired of waiting and do not know when or if they will be able to close escrow. Can we back out, without losing our deposit, based on the fact that they did not live up to the terms of the contract?

Also, to get our deposit back is it necessary to have the signature/agreement of the seller?
