My wife and I are homeowners in Sarasota, Florida. We live on a quite street near a public park and one of the best elementary schools in the county. We were notified earlier this year via a FDLE flyer that the man who rents the house next door is a “Convicted Child Sex Offender”. We just recently put our home on the market. A few days after doing so, our real estate agent notified us that we must disclose the fact that a “Convicted Child Sex Offender” lives next door. We withdrew our home from the market. This kind of disclosure will certainly kill the sale and asking price of our “family type” home.

Do we have any legal recourse against the owner of the home next door or against the “sex offender”?

Are there any other options?

No, you have no grounds to sue.
Options should be discussed with your real estate broker.
