disclosur of condo fee


What is the name of your state? Ohio

i just purchased a condo; the closing date was 12/30/02.
i moved in on jan 2 '03. there was a notice in my mailbox regarding an assessment that was due by april for 850.00. i was never informed of the assessment during the negotiation or at closing. the disclosure by the seller was filled out in september at this time she would not have known about the assessment which was announced in october and voted on in november. is the seller obligated to disclose this information if this occurred after the signing of the disclosure paper. i believe this info would have significantly impacted the negotiation of the sale price if i had known. additionally, should my real estate agent have made a call to the condo association to find out these things before a negotiation took place. should this info at least been shared at the closing. i have proof that the seller, listing and buying agent all knew this information prior to the closing.

**A: yes, the Seller was obligated to update the disclosure to you based on the new information.
