DisclosureWhat is the name of your state? Tennessee I bought a house in March 2001. It was sold 'as is'. I am a trainee real estate appraiser and my boss who is also a realtor acted as my buyers agent. The property disclosure only indicated a 'small spot in the bathroom floor'. This was not a big deal and i have fixed it. When i bought the house, the realtor told me that the ridge behind my home used to contain houses, but they were demolished when the state built a new highway. I have since found out from neighbours that my new house was actually origianlly located there, and it was moved to its present location. This was not disclosed by the realtor and homeowner (if they knew). Also, there is an addition to the back of the home that now appears to me to have been built without permits or to code. This was not disclosed. I have also had a heat and air engineer inspect my system, he told me it was illegally placed and would not pass a code inspection. My questions are: 1) i would not have bought the home if i had known it had been moved. Should it have been disclosed even if it was not done when the previous homewoner was in possession, but had knowledge of it. 2) what can i do about the illegal addition. It too was not mentioned in the property disclosure Thanks for your help Dean |

It too was not mentioned in the property disclosure Thanks for your help Dean **A: I find this very humorous because a Realtor/real estate appraiser should be the very one to know how to do complete research and due diligence. When I appraise real estate, I go to the real property tax office and the building department to review public record source documents. If this was done you would have known about the illegal addition and perhaps that the home was a relocated structure. The Seller is guilty of mispresentation and non-disclosure of material facts but the fact that your Realtor agent boss is in the real estate appraisal business would not be supportive to your case. |
