DisclosureRI. Seller has disclosed that all major appliances included in the house sale were neither in need of repair nor replacement. The P&S was signed and now we are informed that the washer leaks. We were told by the realtor that seller agrees to give $50 as compensation!! One cannot even get a repairman to enter the house for $50!! Since the disclosure states that everything was in good condition, isn't it the seller's responsibility to return it to the same condition? What are my rights or options if seller refuses? Thanks |

| What does your purchase contract state with regard to the condition of personal property? Must it be in working condition or is it being sold "as is"? As far as your remedies, how many days are left on your right to rescind the contract after you signed the Disclosure Statement? If you are still within the prescribed time period to rescind, you can cancel and have your earnest money returned. However, it doesn't sound like that big of a deal, so you might want to consider taking the $50 offer. Have you had the home thoroughly inspected and is this the only thing that was wrong?

| Writer, request that the appliance be repaired by an experienced appliance repair person. That way it would be know if it could be fixed or needs to be replaced. Put the burden on the Seller. If the appliance is old and cannot be fixed, you would rather the Seller pay for a replacement. |
