Disclosure


What is the name of your state? Texas

I wasn't given a Sellers Disclosure at Closing. I now have many problems with the house, some of which I've repaired.

Due to all these repairs, the value of the house was most certainly too high.

What recourse do I have?

None. You would have wanted any disclosures prior to closing to give the Seller adequate time to correct.

I just found out from a Real Estate Attorney that I do have recourse. She was decietful in that she was aware of all the repairs that were needed and played on our inability of kowing what to do, she continued without allowing us a chance to have our own inspection.....

I am suing under the Deceptive Trade Practices Law for repairs as well as addt'l costs....I have a good case. There were other issues involved, but these repairs are what we want the most...the mold has started to become more of a problem..now we have to pay for the testing to see if its toxic, and we found out yesterday WE HAVE A SEPTIC TANK..JOy!! Another thing we didn't know we had...

Where was your Realtor during this transaction? Did you ask for a disclosure? When the water and sewer bills were prorated at closing and there was no sewer bill to prorate, wouldn't that tip you off that you must have a septic?

Just wondering - and the seller's attorney may ask these questions.

That's why when you're stupid, and buying your first home and you trust the person selling it to you..that in itself should be a red flag..(for those of you out there).

We blame ourselves for accepting her explanation of: "You don't need an inspection, my husband already looked at it, it's fine.." We were stupid enough to think that was enough until all the problems started.

On the Septic, most cities in this county add all fees on one bill, including city water which includes sewage and we were advised, once again, by the seller that we had city water and sewage...of course we later found out after we did some research that we don't.

If you are inexperienced and have absolutely no idea what is invovled in buying a home, no matter what state your're in, it's important to do some legwork alone and then find a reputable Attorney to help you out.

We were not aware, that we could actually ask for a Sellers Disclosure..we didn't even know what that was!! Explains why she rushed us into signing..

Hindsight is 20/20....we have a good case and after we got the bid from a Construction Company for renovations....as well as approximated court costs/ atty fees....it's not going to be a good day for her....we also found out she's been doing this for many years to unsuspecting people who were as green as we were and trusted her....but in our case..we're fighting back before statute of limitations runs out..

Well, I wish you luck. I just found out that both my agent and the seller's agent were working without a license. Who would have thought that was an issue to consider. Some of us are inexperienced, naive, and easy prey in that we trust the wrong people. It's even harder to get a sympathetic ear when something goes wrong because alot of people who have the background and experiernce have become so cold and calloused they're not much help. Good for you that you found someone to listen and to help you.
