Disclosure Fraud


What is the name of your state? Colorado.

I purchased a home in December 2005. At the time of the inspection the sprinkler system was shut down due to the winter weather. The disclosure indicated that there was nothing wrong with it. I turned it on, with the advice of the neighbor across the street. The neighbor indicated that the previous owner had trouble with a leaky station, and sure enough one of the stations leaked. Is there any recourse given the previous owner apparently had knowledge of this yet failed to disclose it?

A: Sue in small claims (if it is under the jurisdictional amount for small claims in your state) for the actual amount of direct damages you have (in other words, how much you pay to fix the leaky station).
