Question

disclosure/inpection and my rights


What is the name of your state?pennsylvania I recently purchased a home. I found major defects in the basement such as, buckling walls white mold and black mold covered up by a rug. I had a inspector which did not have any major problems written in his report, just some stains on the basement wall. there was nothing written in reguards to moisture anywhere. In the disclosure questions all things pertaining to moisture,cracks water leakage was marked no by the seller which lived in the home for 10 years. I am no expert but when i looked over everything it looked pretty major . all walls in the basement had problems and nothing was disclosed . I chose an option on the seller's agreement based on the inspector's report if there were any major problems the seller would have to address them before close. What do I do now? Is this a fraud issue. Things appeared to be covered up and the problem looks like it was there for a while. I was in the home only 4 months. Thank you

As a PA Realtor, my suggestion would be to have the areas your concerned about inspected again possibly be someone experienced in mold inspections.
If in fact there is a problem, you will need documented proof that this was a pre-existing condition. When you get this report, call your Realtor and ask how to proceed. It is possible that the prior owner had not looked under his rug in years and could possibly be unaware of the problem. Did you not notice the buckling walls prior to closing? Were you present when the home inspection was done? Did you ask the inspector his opinion of the basement walls?

I did have the inspector come back today. He told me this is not a big problem the walls can be remover along with the mold areas and spray clorox and water. He told me not to contact the realator he would not know anything. The inspector just told me to get rid of it and clean. As for the owner and the rug , there were paper bags placed down first so someone new about it. Thank you for your time!!!!! What do I do now? He also said the mold is not bad. How would he know this by just looking?

disclosure/inspection


I am not a professional in any aspects of the inspection field but, when The Inspector told me this, it seemed he was trying to cover his own mistake. I feel the whole situation looks that it was covered up and I have only been here 4 months. If i noticed (at the wrong time) this problem then why didn't the inspector. He said there were alot of things in the way at the original inspection(and he remembers exactly without notes)I am concerened there has been water problems for a while with the way the walls look. I also have twins 4 months old boys and 2 girls ages 7-9 . My 7 year old is asthmatic brought on by mold and mildew. Do you think it is worth pursuing a lawyer in this matter and will the seller and the inspector be responsible for the costs of legal fees if it is proved they covered it up. again thank you so much.

Get a new inspector, one who isn't going to have to worry about covering his butt.

I am going to get another inspector. I need to know if I have a good case before pursuing legal help. I have four children so money is a big factor especially if the problem is one where I would have to leave my home . I need to know who can come in to give me estimates and the extent of them. I just don't know what to do at this point. please help!!!!!!!!!!!!!!!!1

You will have to wait and see what the inspector says before doing anything else. That will determine if you have a good case or not.

Thank You for your help, I thought that is what I will have to do. I am sure The new inspector will let me know the extent and how long the problem has been there. People are so ignorant to make a buck because I would have bought the house and worked another deal if they told me, now everybody may have to deal with bigger issues than disclosure. I am mentally exausted already and the journey did not even begin.
