as with gst,would it be hard to prove the seller had prior knowledge if the new carpet installed right before i bought the place was installed over holes in the wood floor
or that there was joint compound over the crack that goes halfway through the house, and if it could be proven what redress would i have?

If you exhaust all efforts in obtaining the evidence without success, then yes it would be hard to prove.
Ask the carpet installers, the real estate agents, any other workers that did repair work on the house, previous Sellers, inspectors, agents etc.
Also you need to know why the holes were there ie. due to normal were and tear, termites, wood rot etc.
Was the crack due to a structural problem that the Seller was aware of?

re:homeguru.the holes were due to normal wear and tear ,but were fixed in traffic areas,the holes i found were next to the walls were you would'nt normally walk,and the crack is due to structural problems that would have been caught during inspection if they hadn't disguised the crack as well as they did.the seller was also the agent.

re:HomeGuru.-ok,my question is should i report her to the real estate commision before or after i file a lawsuit-i was thinking of using thier findings as leverage in my lawsuit since it would be unbiased.

File a complaint with the State first but do not hold your breath waiting for the State to act.

Before reporting the realtor to the state, I would contact him/her and discuss the options. Once a report has been made to the Commission, it stays on the realtors report whether the complaint was unfounded or not. If you could work something out, its in your best interest. A complaint can take a long time to investigate. Best of Luck.
