Disclosure of sewer problems


What is the name of your state? New Mexico. We closed on our house on Nov 1st and moved in on the 3rd. By the 5th we had sewage backed up into the tub and shower and could not flush the toilets. We have had 3 different plumbers tell us that this is an existing problem and one that stated he had been the one to clean the sewerline for the every six months for the past 15 years because the sellers did not want to re do the entire sewer line. We contacted the real estate agent and she talked with the sellers and they were to contact us about ther repair. It has been almost 2 months and we have not heard one word from them and guess what....our sewer is backing up again. Am I wrong is the seller responsible? Is this not something that should have been disclosed before closing?What is the name of your state?

Seller probably should have disclosed, but I suspect you are going to need a court to force any payments you get should it be deemed the sellers are responsible. Have you estimates? If so are they within small claims court limits for you area?

Just being right does not mean automatic payment.
