Discolsure Question? Lawsuit


What is the name of your state? Texas

We built a new home in 2006 with a well know builder, and in late 2007 decided to sell our home to move to something smaller. We were able to find a buyer, and we closed on our house in Jan 2008. We recently found out that our previous home was included in some soft of class action law suit between our builder and their engineer. Our builder had purchased back a number of homes in our subdivision due to foundation issues, and I believe the builder is now suing the engineer to put the blame back on them. This has not been confmed, but supposidely our previous home is listed in this suit for having some sort of foundation repair. Our home had no foundation work performed on it! We were contacted by our real estate agent, and the buyers are questioning if we were aware of any problems with our home? We absolutly 100% did not have any foundation problems with our home, and if our home is included in this suit, what do we do? We do not want to be accused we did not do! Any assistance that can be offer would be greatly appreciated as this is very unsettling to my wife & I. Thank you for your help.

Hi,

Do you have any updates on this? Do you know if builders are required to disclose these kind of issues?
