divorce and selling a house


What is the name of your state? Virginia

I have a final divorce decree but have yet to have my ex sign over the deed. I will be selling my house that I was given in the Property Settlement Agreement and was put into effect in the final decree. My ex has been delaying signing over the deed to transfer it over to my name alone. What problems will I have if I go to closing and my ex still hasnt signed over the title? Can I still sell the house without her signature?

**A: you cannot sell without her signature since she is still the legal titleholder of record.

My ex has given me ownership in the in the final divorce decree. Shouldnt that be good enough?

Consult with your attorney and file suit against your ex-wife for breaching the property settlement in divorce agreement. That should motivate her.

**A: to clarify, in your divorce property distribution agreement, your ex has agreed to give you ownership of the property. She has not legally given you actual ownership until she signs her title interest over to you.
This legal and complete transfer of ownership would be finished when she signs a Quit Claim Deed and said deed is recorded.
The divorce decree is merely one step towards your achieved goal.
You need to complete step #2 now.
