Texas, we purchased a mobile home on three acres so we thought a year ago. Now we are trying to sell the property and come to find out there is still a lean against the house and the lender is out of business and the mobile home is no where on the title insurance or other documentations. The title company is trying to fix the problem by sending certified letter to last known address of the lender. It has changed our closing date 2 times now and the home that we are trying to purchase wants 1500 dollars for their inconveniences. Is there any legal and financial responsibility of the title company that we can take legal action against them for their mistakes of putting us out of the house that we want? Is there any ramifications that we can put on the title company?

I bet the "mobile Home" is seen as personal property, it may have a seperate title and could have a seperate lien, is it on wheels?

how much money are you talking about?

In Texas houses like this are in a gray area between real estate and vehicles. They their own department to handle titles, etc... https://www.tdhca.state.tx.us/mh/faqs-sol.htm

I presume you've talked to who ever sold you this property. A lien doesn't necessarily prevent sale but nobody would be fool enough to buy a property subject to a lien.
