Duped? Not What I Bought!


I live in Alabama. I recently purchased a home. I based my purchase off the information I recieved from the MLS and the flier at the home. I have been in the house for 30 days. I discovered that the size of the property does not match the information in the advertisements. The advertisements stated 2.5 (+/-) acres and 2(+) acres. I found out that the lot is only .62 arces. I checked all the document I received at closing and the lot size was not shown. What legal recourse do I have?

What does your written contract of sale that you and the seller signed say regarding the size of the lot? What does your deed say about the size? If it's in a subdivision, what does the plat say about the size?

I am assuming you looked at the place before you bought it. Could you not tell the difference between .62 acres and 2.5 acres?

By the way, the MLS and the flier both say that the information is deemed accurate but the info is not to be used as a warranty/guaranty.

The property is heavily wooded. We were given general land marks but not definite boundries. We requested a survey to outline the actual boundries. We were at closing for approximately 3.5 hours. We were told that the survey was in progress and we would get it that day. It took several days. We did not go to the county office and request a plot size. I guess it was dumb, but we assumed the information that was being given by the seller, seller agent and our buyer agent was correct. I could ubderstand if the plot was off by 1/2 arce but 1.9 acres?

So, you are saying that you have NOTHING in writing that tells you the size?

What EXACTLY does the legal description on the deed say?

there is more to this story like for one, there was no survey and no review of the legal despcrption in the title report**************.....
