My wife and I were renting a house with an option to buy, when the lease was up we opted not to purchase the property. There was an offer to purchase drawn up in my name and my wifes name. I signed the offer but my wife did not. We are trying to get the deposit money back but the landlord (seller) claims that it was earnest money and will not be returned. I believe Wisconsin is 50/50 marital state and since my wife did not sign the offer are we entitled to our deposit back?
