earnest money to hold property


What is the name of your state?colorado

I gave a $1000.00 check to an owner of a property we were interested in, but had some construction work being done to it at the time we looked at it.
He said he would hold it for us with the deposit and contact us when it was complete And at that time would do all the necessary paper work for an owner finace. He gave us a receipt that stated "Earnest money to hold and listed the property address. We had not heard from him and from driving by we noticed some furniture in the front room. After trying numerous times to get ahold of him, when we finally did he said that he left us a message and had not heard from us so he sold it to someone else. He said he had another property if we were interested but he would not refund our deposit.

You have no contract and the Seller should refuind the money to you.
