earnest money seller backing out


the seller of my new construction home in Oregon has threatened that he will break my contract agreement with him and sell my house to someone else if i do not agree in writing to accept the house as is, without him fixing this mistake he made on my house which is clearly inconsistent with the design plan i initialed. If the seller breaks my contract agreement against my will, am I entitled to all my earnest money back? If he refuses to give me back my money, what should I do? He says he spent a lot of money fixing other errors I pointed out to him and will no longer give me back my earnest money.

I want the seller to back out and then give me back all of my earnest money. It looks like though that he's not planning to give me back any of my earnest money. My question is, do I have a legal right to the earnest money? If I do have a legal right, then what do I need to do to get the seller to give me back my money?

You can't force the Seller to back out. Hire an attorney to review the contract and advise you.
