Equity rightsWhat is the name of your state? I purchased a home in California. I contributed $50,000 from the sale of my home toward the downpayment and my boyfriend gave me $50,000 cash toward the downpayment. We were buying the house together in my name only. Since the purchase, he has used that 16,700 to make his portion of the house notes and bills. Now that he has used all of that money, he has not paid for any house notes or bills for four months. Due to his inability to pay for the house and the monthly bills, I am breaking off the relationship and have been forced to get my mortgage refinanced. He now is asking for a buyout and is demanding I pay him what's left of the 50,000 minus what he owes me for the last 4 months house note and bills, plus equity. My question is, if he is not on the deed, is he entitled to equity? Can I charge him interest on the bills and house notes he hasn't paid? Can I make him pay my attorney fees since he defaulted on our agreement to share all household expenses? Can I make him pay my fees for getting the house refinanced so I can pay a lower house note? What are my rights in this case. We made a verbal agreement to buy the house together. |
