Question

Evicting "partner" from house


What is the name of your state?What is the name of your state?What is the name of your state? CA

A friend and I were going to buy a house together in September. It turned out his credit was very bad. So I provided entire down payment, and my name is the only one on title and on mortgage note. He was going to put equivelant amount of down payment into house renovation.

We had no signed or written "partnership" agreement; but there is email correspondance regarding our intent.

To date (since September) his only financial contribution have been monthly payments equaling half the mortgage for about 8 months (sometimes late, one time using a transfer fund check from one of *my* credit cards!), and a few misc shared expenses (e.g., rebuilding a fallen-down backyard fence).

He now wants to be included on the title. I would like to sever all relationship as I don't think he intends on coming through on his financial obligation. An attorney suggested I evict him as a 'tenant'. (This is my primary residence, his secondary residence).

I would like to hear any other opinions on this.
