Failure to disclose


What is the name of your state? WI

We bought a house last August (2007). Over the winter, the roof started leaking around a skylight. My wife saw the previous owner one day at the local school. The owner came over and asked how everything was going with the house. My wife said, "not great. the roof is leaking around the skylight". The owner's son, who was standing there, said, "Oh, that used to happen all the time." This was not disclosed on the property condition report. What are our options?

Im sorry, but you have no other options..
Assuming you had a property inspector at the time of sale, you can go scream at him for not finding anything.. That's about the only thing you can do to let some steam out of your system.

Again I disagree with RealtorRyan.

Write the orignal homeowners a tactful letter asking them to cough up some dough for the leaky roof they conveniently forgot to disclose in the sellers disclosure or they can cough up some dough to defend themselves in court.

Offer them a plea bargain - i.e. you'll accept 60 or 70% of cost to repair if they pay up without going to court or if they insist on going to court you'll be asking for the full boat plus attorneys fees.

The letter should be professional and respectful - you're showing them a courtesy by giving them a chance to settle without going to court.

Include a copy of a bid for repairs and cc both realtors.

I agree but be sure to include something from an inspector proving that this had been going on for a while and that they had to have known about it. Also include the statement the son made as well.
