False Docs by Escrow etc.


What is the name of your state? CA
We closed our house yesterday but have issues:

(a) when we walked in at 5 PM with keys, the sellers had not moved out and as per agreement that should have. We waited 5 hours for them to move out until 10PM. They did lot of damage to the house ripping off furniture off the wall.

(b) We found the termite guys still working. They had given us a certificate that termite was completed on March 23rd (i.e. lying?). The termite guy told me that he merely painted some wood outside whereas there were many section I items (and all that was done). The certificate lists tons of items. Originally the seller was recommended to fumigate but he got another inspector to say that he does not need it.

(c) Escrow company (owned by sellers agent) made us sign a paper on 28th that was dated 29th that all retrofit work was completed. Retrofit work has not been completed even after close as we got a call that they guy will be there tomorrow. Again lying on retrofit company and escrow company making us sign a forward date doc

(d) The sellers agent threatened to call police (at 7PM) that why we were there when seller was moving out rather than apologizing (it is in written contract that seller would move out by 5 pm. They gave us the keys!).

Please let me know what is worth doing here and where do I have merit for a case against sellers agent/seller/escrow company? Any advice.

Did they use a gun or knife or perhaps a mafia goon to accomplish MAKING you sign? No one can make you sign anything in such transactions.

However it seems you have issue and since you mention the seller's agent and not your own can we assume you have no agnet and no Atty who is representing your interests?

you can try small claims for your state's maximum or see an Atty if the amount is substantial.

My question is specifica to how much farud is it that they have issues certificates of work completion when it is not? Would the escrow compnay be liable or the vendors who gave wrong certificates.

Honestly I do not know what kind of certificates you are talking about. Who issued the "certificates" and what exactly are they for?

The certificate lists tons of items.

No one here can tell you what kind of case you might have on this without seeing your all of your paperwork.

Perhaps NOW is the time to get an Atty who CAN look over everything and tell you what your next move should be.

We would not know if the work is completed or not so for anyone here to say they committed fraud just is not fair.

Look, the certificates are: (a) Retrofit Compliance certificate that all toilets are installed and that earthquake safety valve is installed. This certificate was issued without work done (and completed today when we found out). Escrow company asked us to sign it that we understood that work was completed. (b) Termite certificate said all section 1 were completed on 3./23 whereas they have not done so (part of the work was done yesterday. Also the sellers ripped off attached cabinets in the house with paint off and nails all over. Hope that helps.
