FL - Forfeit of good faith deposit

We attempted to sell our home by owner. The buyer was not able to close on the agreed upon date. We gave an extension with a stipulation that if the deal did not close on new date, there would be no more extensions and the $1000 good faith deposit would be forfeited. The buyer is now refusing to sign the release and the title company has sent the deposit to the registry of the court (Palm Beach County). Is there a way we can get that deposit with hiring an attorney? Can we just file a small claim court suit?
