Flood in recently purchased resale - recourse to seller, inspector, etc??


What is the name of your state? Maryland (Montgomery County)

Summary
Purchased home at end of April. Had inspection. Moved in early May. Had a flood in the basement last night. Turns out there was a backed up drain in the basement that was carpeted over. The backed up drain caused the flood. This is obviously not 'to code' and may be VERY expensive to repair. Also, the airconditioner in the basement is illegally draining into the septic system.

What are my rights? What kind of recourse do we have with the previous owners? inspector who should have found these things? Real estate company? etc.

About the drain being covered It was not noticed / listed by the inspector and just out of curiousity didnt you notice the area around the carpet being a bit sloped or lower than the area around it? What was the cause of the back up? the drain it self being covered is not a reason for it to back up? but things like tree roots clogging main lines. things people pour down drains and flush are what contribute to backups normally. SO has a lic plumber examined the waste water lines to give you a opinion as to the cause ? You also state >>Also, the airconditioner in the basement is illegally draining into the septic system. << this is another to ask your city/county govt center about, Fair odds are only homes connected to city/county sewer systems are not allowed to have sump pumps or maybe A/C or dehumidifiers drain to city sewer lines but ill bet homes with private septic systems are not addressed, only because its in the interest of public sewer systems to not have non waste water over load them. Once you know what your city /county ords are in relation to the problems you mention then you will know better if this is something to act further on.
