Foreclosure at Probate

What is the name of your state? Nv.
I came across a house that is in default. We called the person who was foreclosing and he agreed to sell us the note ect. This person was a lawyer who had lent a woman money based on putting up her house. Well, this woman passed away a year ago. Her house is about to go into probate and the lawyer who agreed to sell sent the trust lawyer a letter saying he was foreclosing and he had no response. When we called the trust lawyer he told us we can not foreclose and why, because he could sell the home for FMV.
We did not want to profit,we wanted to move in.
In a nutshell.... Can we foreclose on a home just before or while in probate??
We are in Nevada.
