Former Mortgage Company Liable


I am currently refinancing my home to take cash out towards the purchase of another home. My current deed has two old mortgages from my mother whom I purchase my first home from. My mortgage company can not get the release of Deed/Trust from the previous mortgage companies there for causing the refi to not be completed. Without that I can not come up with the cash I need to purchase the new home and the deal is ultimately dead and I have signed a sales agreement assuming there would be no issues. Can I hold the former mortgage companies that show on the deed Liable for causing the deal to fall through because their lack of oversite in ability to respond????

Looks like Law school was too hard for you, so you settled on a second rate substitue teaching gig .... Oh well get a life .. stop browsing the forums to make yourself feel better.

Well I am an attorney, and I agree with HomeGuru but I will add this -- don't ask for advice and then have a fit when you are told something you didn't want to hear.

Thanks for your time ... I wasnt having a fit over his answer .. I need to talk to someone who is fully qualified not some dick who is cruising the forums looking to stroke his ego ... he is a teacher not a lawyer .. Im a software analyst does that make me fully qualified to dispense legal advice no I didnt think it did ... Opinions are like *******s .. everyone has them. So unless that opinon is from a qualified professional then they are basically ****... thanks and have a good day

or to be buying homes. Stick to computers. And while you're at it see if you can find the ' key on your keyboard. Bet it's really hard to code without it!
