Found some issue which the seller tried to hide


What is the name of your state? NC
Offer and deposit have been given to the seller. We just found some critical issue regarding the property which was not listed in the disclosure statement. The property is right beside a future highway(in 2-3yrs), can we cancel the contract and get our deposit back?

How do you know the seller knew this?

What difference does it make?

Why do you think that seller (assuming he knew) would not tell you?

Why did y'all not know this: it is public info and was in all the papers and they had hearings on it?!

What did the real estate agent say when (before you put down your deposit) you asked him, "Are there any new highways going up around this property?"

The property will increase in value once the highway goes through; don't you want that?

How do you know the seller knew this?
The seller's neightbor disclose this in their statement.
What difference does it make?
This will affect the value of the property
Why do you think that seller (assuming he knew) would not tell you?
same as above
Why did y'all not know this: it is public info and was in all the papers and they had hearings on it?!
i'm new to this area. some area may not has this issue
What did the real estate agent say when (before you put down your deposit) you asked him, "Are there any new highways going up around this property?"
Nobody mention anything like this. Found out when check the neightbor's selling package.
The property will increase in value once the highway goes through; don't you want that?

Can we back out legally due to thier fraud, if I can say this?

Seller disclosure statements generally deal with the sellers' property. Unless the highway will go straight through the house, I am not sure that there is any fraud.

Oh so you are loking for leverage, but why offer more than the market? It sounds like you didn't consider your sale too carefully.

Highway


Homes near highway won't decrease in value....
I've sold enough homes behind highways and railroads
to say, if the market is hot, buyers don't care or if they do care
we have enought buyers that won't care.

Check out OP's prior post...he's just trying to justify his default on a contract.
