Getting down payments back.


What is the name of your state? Maine.

Hi,,We put a $1000.00 down payment down on a new house, and put $900.00 into the lighting and cabinets. We had to buy the lights out of pocket so we could get what we wanted, and added an island in the kitchen. Us buying the new house was under the condition that our present house sells first, which it did not. We asked for a month extension and got it, but our present house still did not sell. The seller/builder would not give us another extension, and backed out of the deal. No Problem, until he said we are not getting a dime back because the carpet was not neutral enough and he feels like he cannot sell the house as is. Well, the carpet is not even in yet! Either are the cabinets. The carpet we picked out was out of "his" allowance package,,,in other words what he previously looked at and must have thought it was ok. We are very displeased with the bulider and his realtor, Busgue Construction in Windham Maine, and Century 21 in Standish Maine. We are going to fight this to the end. What should we do? We will have to go to mediation, in which we will demand the full $1900.00, but if we do not get what we want we will have to sue. Can we take them to small claims court? Should we get a lawyer now? I am even willing to take MY lighting and ceiling fans back, but was told if i enter the house i will be arrested. Getting arrested retrieving property that is mine, i have the reciepts, sounds a bit extreme. What should we do? So much for good faith agreements i guess.

You need to hire an attorney and fast.
