Getting out of a listing contract


What is the name of your state? AZ
Hi,
We have a similar situation to other posters here, but have not found an answer specific to our situation. We are not satisfied with our real estate agent, and don't feel that she is properly representing us.

We got behind in our mortgage payments, due to me losing my job about a year ago, and are now facing foreclosure. The home is worth about twice what we paid for it, and we currently have it listed (has been listed for almost three months).

We have a virtual tour available, and are requesting that prospective buyers view the tour prior to seeing the house, since we have four dogs and a daughter, and it is not always convenient to clear everyone out so people can see the house. We feel that our rights have been violated every step of the way, and would like to get an agent that actually believes in our house and what it is worth, and really sells it to people.

Also, we would like to know what the actual laws are regarding foreclosure in Arizona. We were told that we have up until the day before the auction to get an offer. Is that true, or what? Any advice would be greatly appreciated.

Could be that you're looking in the forum for buying and selling homes, and not the foreclosure forum.

do you have an appraisal, or is this what your agent told you? Big difference in the two.

If I were facing a foreclosure, 3AM would suddenly become damned convenient to clear everyone out!

To What rights would you be referring? You make no mention of any specific rights violations - privacy, racial discrimination, etc

I agree with Danno.

There's nothing like the real thing
. And, you can request anything you want from prospective buyers but, making them do it is another thing.

If you have something that you really want to sell, it is in your best interest to accommodate the potential buyer

You request that potential buyers look at a virtual tour BEFORE they look at your house! You have turned down (I gather) buyers because it is inconvenient for you to vacate one daughter and 4 dogs!
If you wish to know why your house is not selling - look in the mirror.

I have to agree. If a party really wants to sell, they get any qualified buyer in for showings , not based on what is convenient for them but what works for the buyer. I can't tell you how many times a property which refused my buyers a showing was simply skipped, and never sought again. Those buyers DID buy, but they bought something else they saw that same night we couldn't get into the other property.

Don't ever refuse a showing, if you can help it.

A Hassle, but worth it


I put my own house on the market, the week after my son was born. People came from all over, even stopped by without agents at all hours. My house sold in no time flat and we moved with a 3 month old to a bigger place.

It was a hassle, but I got what I wanted, we were diligent and little baby learned to sleep through a lot of shuffling around the house.
