Getting a previous owner out!What is the name of your state (only U.S. law)? I live in Texas. My husband and I closed on a house a month and a half ago. The previous owner has until tonight at midnight to get out of the house. She still has a lot of stuff at the residence and will likely not be out by midnight. | By not insisting they were gone before closing, you now have a tenant and must go through eviction or notice to quit process found in landlord/tenant law.

| Did you sign the standard lease form that usually gets signed at closings when the Seller is going to occupy the house after closing? If so, you have to follow the provisions in that lease to evict her ... Typically, that lease has a per day rate that the Seller has to pay, which should offset your damages ... |
