My sister-in-law bought a house with her roommate. Both names are on the mortgage. They break up emotionally and the roomate moves out leaving personal property in the house. The roommate does not make any attempt to help with the mortgage payments over the course of months. They agree to sell the house and put it on the market with a realtor. The roommate refuses to pay any of the mortgage, nor will the roommate sell half the equity to my sister-in-law.
When the house sells, can my sister-in-law recoup half the mortgage for the months the roommate did not pay at all? Can my sister-in-law take in a boarder, charge the boarder rent and put all the rent toward the mortgage? Will my sister-in-law have to pay the roommate half the boarders rent after the sale of the house?
The roommate is renting an apartment and has a history of bankruptcy. The roommate does not care about any credit standings.
Is there any way to force the roommate into signing a quit claim deed? What steps need to be taken to remove the roommate from the mortgage and her property from the house?
Please advise.
