hardship backout of home purchase

My ex wife moved herself and her husband and my two daughters to Colorado Springs bought a new house and gave $16,000 down payment on 3/21/2003. Her husband wasn't working and abusive and she threw him out of the house and filed a restraining order as of 4/15/2003. She is broke and needs to move herself and my daughters back to her mother's house in California. Since it has been less than one month and she has faced hardship can she recover all or part of her $16,000 deposit?
