Heater condemned after 1 year


What is the name of your state? California

I February of 2005 we bought a house. Our realtor said we should pay to have the home inspected. She went through and seemed pleased with majority of the things she saw. The previous home owner was proud of the work that he did. He was a licensed HVAC contractor with his own business. He had installed a furnace 9 years prior to us moving in. About 3 weeks ago this furnace went out; it only blew out cold air. We had a home warranty so we called to have it fixed. The first company that came out and said he could not fix it because it was put in illegally and there were so many code violations. He said the heater was also sending exhaust back into the closet in which it was located, which was possibly going back into the house. The home warranty people didn't believe this report, as well as our realtor, so they sent out a second opinion. The second opinion came back with the same results. The home warranty allowed us to buy a personal heater up to $75.00 because I have a 1 and 3 year old at home and due to the cold weather the house was cold.

My friend told me to go to the city and pull the permit for the heater. When I went do to the city office they had no permit for the heater or AC. The city did however have a misc. permit saying they wanted to work on the heater but nothing else was filed. I then looked at his license for HVAC which he let expire in April of 2005 for California because they were moving out the state but I think he has a new license in the state in which they moved to. We need to have this fixed ASAP because we are all living in one room with a space heater. My kids have kept colds for the past two weeks due to the house being in the 50's. Please help as to what I need to do next.What is the name of your state?

The previous owner did not disclose this heater being illegal in the sale, he should know being a HVAC person.

Make sure to check code compliance laws 9 years ago when he first installed it as codes do change. Today it may be illegal but maybe not back then. As to permits, generally the city does need to come & inspect the furnace after installation. If he "skipped" this step it would be a fishy thing to me...
