NC: Buyers made offer to purchase, we accepted, agreed to all of their "requests", made repairs as needed. During final walk through, buyers "discovered" that the house next door to ours was a group home for troubled children. When the buyers made the offer on the house, the house was empty, noone was living there. The buyers have refused to close (closing was @ 9 am on 7-25). The original closing date was set for 7-25 however during the inspection, the buyers asked if we could "up" it to 7-6. We all agreed. I took time off from work to "prepare" the house for closing. On July 10, 10 minutes before I was leaving work for my "time off", I received a phone call from my listing agent notifying me that the mortgage company said closing could not be done on 7-16 & that he had told the buyers agent several times that that date was impossible due to the Independence Day Holiday. We started moving out on July 8th to accomodate the buyers.
What are our options? We have incurred unnecessary expenses, first, because of their agents actions about the closing and secondly, because of their refusal to close. We are paying a house payment & rent until this can be resolved. What are our options? What is the best way to resolve this problem? Do we possibly have any legal action?
