Help, my husband put the house for sale w/out my signing any listing, purchasing, or counter offer documents. The house is in both of our names. Apparently everyone ( agent, buyer agent, and title company
) missed this when drawing up the paper work. I brought it to there attention when I mention that the offer was not good. My agent then told me they didn't need my signature because it was a common law state
**A: you agent is an idiot. Common law has nothing to do with having the right to sell as a title holder on the deed.

and the buyers could sue to make us sell or we would have to pay damages.
**A: that part is correct in that the Buyers could sue for specific performance.

I have been asked repeatedly to sign and I won't because I do not agree. Subsequently I have been stressed and this has stressed the marriage because of threat of possibly being sued. Is there in fact a valid contact if I did not sign? |
**A: yes, legally there is an enforceable contract between your husband and the Buyers. Your marriage was already stressed if your husband would go behind your back and sell the house without you.
Talk with the principal broker because SOP dictates that all agents must get the signatures of ALL sellers on the listing agreement. You can fight this issue with them and threaten to sue their asses.
