Home/pool warranty part of purchase but...

I purchased a home last November and part of the deal was a home warranty and a swimming pool warranty. I was provided the brochure about the warranty and received some additional brochures from the warranty "place". When I opened the pool in the spring, there was an electrical problem and according to the brochure, it was covered. Problem was when I called the warranty people, they told me I didn't have the pool coverage, just the home coverage.

Called realtor and she said yep - they dropped the ball and the pool warranty fell through the cracks and they would see what needed to be done to get it in place. At the same time, she asked me if it could wait till the home warranty came up for renewal in November - of course my reply was no.

It is now August 1 and I still don't have the warranty. My filter is leaking and it is another item that is covered. The story the realtor is giving me is the warranty place is giving them the run-around and they want to do an inspection and if something is broken it would be considered an "existing condition" i.e. not covered. Supposedly the realtor has contacted the state insurance dept. In the meantime, I am without a warranty that I need to take advantage of. And I have the purchase agreement stating it was part of the purchase aggreement. I sent the realtor an email and she again encouraged me to wait stating if I got the warranty now I couldn't renew it. That was two weeks ago and I haven't heard a peep since.

What are my rights here? Aren't there other warranty companies? What can I do to get this warranty and get the leak fixed. This leak is causing other issues (like mosquito haven!!) and could possible cause additional damage to the filter.

You should get two estimates, repair your pool and enjoy it for the rest of the summer. Then you need to get the real estate company to make good on the cost. Realty sales people have what's called Errors & Omissions insurance that should pay for this kind of error. If they don't make good on it you will probably have to sue them in small claims.
