House Under Construction Burnt Down


What is the name of your state? Virginia

Hello there. We are building a house in Virginia and unfortunately this weekend it burnt down to the ground. An arson investigation is underway right now and because the house wasn't finished it is still the builder's responsibility to rebuild. My question is if there is any legal recourse we can take against the builder at this point because of the additional delays in getting the house done (especially if they are found at fault after the investigation or if we can prove that they did not provide adequate protection of the properties in general..) I don't think we will have a leg to stand on because the only way this really affects my family monetarily is that we have to wait on selling our current house now at a time where the market may not be as well off. Also the contract we have with the builder states that they have 2 years to build the house after contract has been signed. Could you offer any advice on what we can do with this situation or do we pretty much have to bite the bullet and just wait longer for the house to be completed.

**A: your remedies would be as stated in your construction contract.
Read it and get legal counsel.
