How can I fire HORRIBLE Listing Agent?


What is the name of your state?Delaware
We listed our home 4 weeks ago. We are in an area that is HOT! Houses sell in usually about a week. After two weeks and a home in my town has not sold people begin to wonder what is wrong with it. Our home has been redone ect. and shows really well. We are asking 15K under the market because my husband is being transferred and we need to sell fast. Our listing agent we feel has screwed up horribly and want to fire him...
First... Our MLS listing is in the WRONG TOWN! He has us listed in a low income area of our township, so our home looks WAY OVER PRICED. He has that we do not have a front porch or patio, when in fact we have both. Our back patio is very large and used all the time for entertaining. He has our sq footage wrong and our taxes are listed 400.00 MORE than they actually are. We mentioned all this to him and he said he would fix it. He has yet to do so.
Next, he NEVER returns phone calls. We have had 15 showings and no feedback at all. His own agency has yet to show our home. We have asked for a brokers open house.. He told us we are in "PIKE CREEK and the town sells the home, you don't need an open house." We asked for a reg. open house and got the same answer. We asked if there is anything that needs to be done to the home and got the same answer.
We have still not gotten our listing contract from him. It's been 4 weeks since we signed.
Last week an agent came to our house. He said that he tried 3 times to set up an appointment to show our home and the agency never called him back. He said he figured he would just try to show it on his own.
My husband told our listing agent we were very unhappy last week and he told us that if we try to get out of our contract he will just hold all showings until the contract is up in 3mths....
I feel like our hands are tied. We are just about ready to get a lawyer to see if we can get out of the contract WE STILL DON"T HAVE A COPY OF.
Here's the kicker. He is the agencies BROKER, so there is NO ONE to go over his head.
Can anyone advice as to what we can do?

**A: the Board of Realtors and the state consumer protection office that regulates real estate licensed brokers is over his head. His E&O insurance carrier and their attorney is over his head. You can go over his head and and his head on a chopping block. YOUR attorney can go over his head.
