How long and do we have a case on disclosure


we live in Indiana and about two years ago purchased a small house.

the problem we have discovered is that the roof is leaking and we feel that the seller misrepresented his knowledge of this condition. stating he had no knowledge of any leaks.

we have since found a can of kilz stain covering paint in the shed and have had several problems with the roof.

is it too late to try to recover some of this cost?

also the square footage was misrepresented on sellers statement....

Did you have an inspection or appraisal? Most people do have kilz on their paint shelves, that's not unusual. How long has the roof been leaking? If it was leaking as soon as you moved in, you should have contacted the realtor and the seller. It's a lot harder to document how long a roof has been leaking after 2 years. You can't always count on a roofer either, because their job is to sell you a new roof and will tell you what it takes. I would hire a roof CONSULTANT (he doesn't make any money on selling you a new roof) or have an inspection. Also take into account the age of the roof, it may just be time.
As far as the sq. footage goes, that was also something the appraisor should have confirmed and a very common mistake. That's why most realtors now list the footage as zero on the disclosures because of liability if it's wrong. Sometimes the tax appraisers, title companies and sellers are all recording different information. That doesn't mean that the sellers were negligent, they are probably just repeating what they were told. Best of luck.
