How to Terminate a Listing Agreement with Agent


What is the name of your state? TX

We have a listing agreement with an agent that expires on 7/14/2004. In our opinion, he is not getting the job done and we wish to terminate the listing agreement with him and relist with another agent.

I don't see anything in the listing agreement that explicity states termination procedures. But the agent states that there is no way out until 7/14.

Any suggestions? I know that if we terminate and someone that has previously seen the house purchases it, then we will owe this idiot a commission and that I am not really concerned about - I just wish to obtain an agent that is capable of performing even the simplest tasks.

We had very similar complaints with our listing agent. After multiple blunders and problems, we contacted HIS broker (supervisor) and asked that he get involved to help solve our problems. He did and despite an overly aggavating experience all together we finally closed(our problem wasn't with getting an offer, it was the nightmare between the contract and closing...but that another story....) BUT, most REPUTABLE real estate companies will let you out of the "contract" if you they are unable to resolve the problems to the customers satisfaction. Of course most realtors are very defensive and blame the "market" or whatever. If your complaint is simply because the house has not sold yet, there are a variety of possibilities as to why. But if your agent is simply someone waiting to cash their commission check (which ours was, God help him...) Then I'd get the office supervisor involved, and request (kindly) to be released from the agreement.
AND, if your complaints are truly grounded, I'd suggest posting a complaint with TREC (Texas Real Estate Commission.) Realtors are paid to be the experts, to represent you and your best interests, NOT to simply sit back, do nothing, and wait for closing.
Any realtors reading this don;t get upset, I've had awesome AND crappy realtors...but this last sale took the cake... Good Luck! I hope you're not from Amarillo...because if you have our realtor I can definitely understand your pain! LOL.

The answer is not in the real estate's agent's assumption of what ends the listing agreement. The answer is clearly written on the agreement itself.

The facts, once provided, should be interesting.
