a hugh mess


Arkansas- Almost 2 years ago my aunt died. She did not leave a will. She had 3 children. 2 agreed to sell for x amount of dollars and the 3rd refused. Well we bought 2/3 of the house which is in very bad shape with termites, water damage from leaking pipes, leaking roof, you name it and it's there. Well we spoke to a lawyer who said that we could file for partition but it would cost more that the house is worth but that owning 2/3rds gives us the right to do whatever we want and the other person can't do anything other than file partition himself. Needless to say this person can not be delt with. We found out that he had a judgement on child support but we can't find out if it was settled or not the records don't show and we can't get that info without his consent. He thinks that we have to inform him of anything we do to the house and he can come and go as he pleases without our consent. Is there anyway we can find out about the child support issue without his knowledge. I understand that the child support agency can siege his 1/3 to pay his debt. And does he have a leg to stand on about any of this. He keeps telling us that his lawyer will be in touch but I don't think he has one.

Please advise how the children aquired the property ie. via joint tenancy with mother (your aunt) or by confirmation of the Probate Court.

huge mess


the 2 sisters talked to a lawyer who advised them that they could sell their interest so they went to someone who works for an abstract company who deals with this type of thing and did all the paper work and filing and worked up the deeds to sell but when it came time for the brother to sell he refused so we purchased the sisters part because it joins our land.
