i need help


Texas**************we sold a mobile home on contract the contract states that the property stay in my name until they secure financing they buyers agreed to have it in thier name within a year that year is up however we did not put that in the contract they are friends of mine and i trusted them it is just a simple contract it was not noterized or whitnessed. there is 19000 left on my origanal mortgage and my mortgage company has no idea we sold it. something has come up and i have to get it out of my name i spoke to the buyers about this and they refused to secure financing i even arranged to have them try to assume the loan and they still refused. my question is can i take the home back or force them to aquire financing thank you

**A: you have a serious problem because you decided to be your own real estate agent and attorney. You did not place protections for you in the contract, did not use the proper contract form and did not notorize and record the contract.
If your property concerns real property rather than just the mobile home itself, you need to hire an attorney. Otherwise go to small claims court.

thank you for your reply it was very helpful and what can i say you learn from your mistakes. instead of going to small claims court and all the legal fees that involves could i not force them to move out of my mobile home so i can place it with a realator ....it is just a mobile home there is no real property involved.and the home is still in my name.

**A: in that case, since there is no real estate involved, the sale involves personal property. Since you still have title, evict them.

Thank you again that was extremely help full i am going to give them until august 1st to get it in thier name and then i will evict them however I have 2 questions 1. can they take any legal action against me. and 2 what are the proper steps i should take to evict them ************** again let me say thank you your advise has been very helpful.

**A: August? That's your problem, you are letting then get away with things. Hire an attorney now and do things right from now on.

i served them with an eviction notice and they replied back that they have a lawyer and thier contract is valid and they do not have to move so now what i cannot afford a lawyer because i have to pay to have the house moved is she bluffing? can i have the house moved anyway with her things still in it? I dont want her things but I want my house can a judgement be awarded forcing me to sell her my house and leave it in my name? stopping me from getting any thing else financed? any help would be appriciated thank you
