Inspections and buyer's rights


What is the name of your state? CA

I'm first time buyer and not sure how to nav. 2 problems: 1. had inspector out and he found water heater not up to standard and need smoke detector, 2. termite inspector's report said there's termite found in house. Realtor is trying to finalize sell w/o resolving these issues. What are my options?

If the sale is based upon the findings of those reports and/or repair of those issues, you can simply say "STOP", until the issues are remedied.

Ultimatley it is dependent upon your purchase agreement. If it requires a termite inspection ans gives guidance as to a positive finding, then that needs to be followed. If your PA requires your acceptance of the water heater situation or it gives direction if there is a inspection problem,, again it needs ot be followed.

SO, what does your purchase agreement state concerning these matters.

A water heater and a smoke detector are NOT big ticket items.

Termites: - in my state is something that the seller must correct. Read your contract carefully to see how CA handles the pest problem.

The only issue I'd even bother with is the termite issue- I agree that a water heater and smoke detector are fairly minor issues. Heck, I upgraded all the elecrical, buried the power lines,. The seller is not obligated to do anything not agreed in the offer - and you are free to walk from the deal in light of the inspection report.
