Issue with title company


What is the name of your state (only U.S. law)? Maryland

We sold our house in Baltimore in Dec. 2008, and awaited our escrow refund.
When we received only @ $200, we contacted our mortgage co. and they said they had paid the City of Baltimore taxes through June 2009 3 days before we settled. They said the credit should appear on our settlement sheet. I checked the sheet, and we were not credited. I since contacted the Title co., and they said they'd try to get the funds back from the City of Baltimore, or get funds from the new owners to pay us back, and send us the money when they got it.
I wrote back and said they should pay us now, and get reimbursed once we either received the money, or they got the money. I assumed the mistake, and therefore the onus of waiting for the money, was on them. Is this true? Are they at fault for this mistake, is it legal for them to make us wait? Should we simply contact the City of Baltimore ourselves?

**A: since the titel co. messed up, they should pay (remimburse you) out of their own pocket.
