| | | j porter What is the name of your state (only U.S. law)? Florida. My wife and I live on a piece of property that has 2 houses on it. We live in 1, that my grandmother left us. My parents used to live in the other one. They took out an equity line, that they ended up not being able to pay. They decided to sale the property to my wife and I. The loan was approved on our end, but do to the fact that there were two separate residences on one property, we had to jump through a lot of hoops. During this time, my parents let the property go into foreclosure. We are having a very difficult time communicating with my parents lender. After months, they finally gave us a counter offer on our original offer. My wife and I accepted, and our lender faxed the paper work to set up a closing date. It has been over a month, and we have not heard back from them. If you call the person that the case is assigned to; you get a voice mail. If you call the main number; you get someone who is going to send someone else an email. in either case, you don't hear back from them. You never get the same person twice, and you rarely get the same state or country twice. Do we need to get some legal help to move the sale forward? |

How could your parents mortgage a property on land owned by all of you? On what legal description did they foreclose?

| | | When my grandmother passed away, my name was on the property. When my parents went to get the loan there was a problem. They had my mother and I down as a married couple. We went and signed papers in order to correct this. I read the paper stating this info, but it was one of about twenty. Somewhere in the stack there was a quit claim deed, stating that I sold my part of the property to my parents for $1.00. My wife and I found this out when she starting investigating public records online. These are my real parents. The property is in foreclosure. My parents have been served papers. The mortgage co. has put the forclosure on hold for the short sale. Problem is; nothing's moving. |
